Terms of Service

1. Agreement to Terms

By accessing or using techserenityit.com or the Invoicer application ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms are entered into between you and Tech Serenity IT, Al Maabela, Muscat, Oman ("Company", "we", "our", or "us").

2. Description of Service

Tech Serenity IT provides an IT solutions website and the Invoicer web application — a free online invoice generator that allows freelancers and small businesses to create, download, print, and manage professional invoices.

3. User Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must be at least 13 years old to create an account.
• One person may not maintain more than one free account to circumvent daily invoice limits.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Create fraudulent invoices or engage in any form of financial fraud.
• Impersonate another person or business.
• Violate any applicable laws or regulations.
• Attempt to gain unauthorised access to other users' accounts or data.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Use automated scripts or bots to create invoices in bulk.
• Upload malicious code, viruses, or any content that could harm the Service or its users.
• Use the Service for any unlawful, harmful, or offensive purpose.

5. Your Content

You retain all rights to the content you create using the Service (your invoices, business information, logos, and client data). By using the Service, you grant us a limited, non-exclusive licence to store and process your content solely to provide the Service to you.

You represent that you have the right to use all content you submit through the Service and that your content does not violate any third-party rights.

6. Intellectual Property

The Service, including its design, code, templates, branding, and content (excluding user-submitted content), is owned by Tech Serenity IT and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our written permission.

7. Advertisements

The Service may display advertisements served by Google AdSense and other advertising partners. These advertisements help us provide the Service free of charge. By using the Service, you acknowledge that advertisements may be displayed and agree to our Privacy Policy regarding the use of cookies for advertising purposes.

8. Service Availability and Changes

• We strive to keep the Service available 24/7 but do not guarantee uninterrupted access.
• We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.
• We may change or remove features, including daily invoice limits, with notice.
• We are not liable for any loss resulting from downtime or service changes.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

We are not responsible for the accuracy, completeness, or legality of any invoices you create using the Service. You are solely responsible for ensuring your invoices comply with applicable tax and legal requirements in your jurisdiction.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECH SERENITY IT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR BUSINESS OPPORTUNITIES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR OMR 10 IF YOU HAVE NOT MADE ANY PAYMENTS).

11. Indemnification

You agree to indemnify, defend, and hold harmless Tech Serenity IT and its officers, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may terminate or suspend your account immediately, without notice, if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time by contacting us at [email protected].

13. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Sultanate of Oman. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Muscat, Oman.
